Terms of Use

1. Who we are and what the service is

HypN (hypn.app) is a personal-change support service built on personalized hypnosis audio sessions, published by Apex Horizon, a French simplified joint-stock company (société par actions simplifiée) registered under SIREN 919 388 926, with its registered office at 171 Grand'Rue, 74350 Cruseilles, France (EU VAT number FR17 919 388 926). These terms govern your use of the service. You accept them when creating your account, after reading them in full, and again whenever the text changes in substance.

2. Nature of the service — wellbeing, not medical care

HypN is a wellbeing and personal-development service. It is NOT a medical device, a medical treatment, or psychotherapy.

HypN does not diagnose anything, does not prescribe or modify any treatment, and never replaces the advice of a physician, pharmacist, or mental-health professional. If you are under treatment (in particular for anxiety, depression, an addiction, or pain), you must never change or stop that treatment without medical advice — whatever progress you feel you are making with HypN.

Results vary from person to person. No specific outcome (quitting a substance, losing weight, sleeping better…) is guaranteed.

3. Safety rules and contraindications

Only listen to a session at a time and in a place where you can safely close your eyes. It is strictly forbidden to listen to a session while driving, operating machinery, or in any situation that requires your attention.

Hypnosis is not recommended without prior medical advice if you live with epilepsy, psychotic or dissociative disorders, severe heart conditions, or a high-risk pregnancy. If in doubt about your situation, ask your physician before using the service.

HypN does not handle emergencies. If you are going through acute distress or having suicidal thoughts, reach out immediately: in the United States, call or text 988 (Suicide & Crisis Lifeline); in the United Kingdom, call the Samaritans on 116 123; in the European Union, call 112; in France, call 3114. Wherever you are, your local emergency number comes first.

The service is restricted to adults (18 and over).

4. Account and access

Access is currently by invitation (beta version). You agree to provide accurate information when you sign up and complete your welcome interview: your sessions are built from your answers, and their quality depends directly on them.

Your account is personal. You are responsible for keeping your login credentials confidential. The audio sessions generated for you are for your personal use only.

5. How the service works and human review

Your sessions are custom-built from your welcome interview and your feedback, using automated generation technologies (artificial intelligence) for both text and voice.

Every program and every session is reviewed by your coach — a human — before it is offered to you. This is a quality and safety guarantee, and it means that an authorized person reads the content that concerns you (see the privacy policy).

Session availability may vary (usually within 24 hours after a step is validated).

6. Your commitments

You agree to use the service for your own personal support only, not to share, resell, or distribute the audio sessions, not to attempt to bypass the service's security measures, and to follow the listening rules in section 3.

7. Prices, payment, and invoicing

During the beta, access is free for invited members — and stays free for them. Any move to a paid offer is announced clearly: nothing is ever charged without the price being displayed beforehand and your explicit confirmation.

The paid offer is a one-time payment per program (the price depends on the number of goals and is displayed before any payment), with no subscription and no automatic renewal. Payments are processed by Stripe, a secure payment provider; we never see or store your card details. An invoice is issued automatically for every purchase, sent by email and available at any time in your settings ("My purchases"). Displayed prices include applicable taxes (VAT) as shown at checkout; the invoice details the net amount and the tax.

7 bis. Right of withdrawal (digital content)

Your program is personalized digital content that you ask to access immediately. In accordance with Article L221-28 of the French Consumer Code, by ticking the box provided before payment you request immediate performance and expressly waive your 14-day right of withdrawal.

Beyond the legal framework: if something is wrong with your program, write to your coach from the app — we always look for a fair solution (fixing a session, a commercial gesture) before anything procedural.

8. Intellectual property

The service, its brand, its interface, and its content are protected. The audio sessions generated for you are licensed to you for personal, non-exclusive, non-transferable use. The words you entrust to the service remain yours — how they are used is governed by the privacy policy.

9. Availability and liability

We do everything we can to provide a reliable service, without being able to guarantee uninterrupted availability (maintenance, incidents, technical dependencies).

The publisher cannot be held liable for damage resulting from use that does not comply with these terms (in particular section 3), nor for decisions you make on your own about a medical treatment in breach of section 2.

10. Deleting your account

You can delete your account at any time from the app settings ("My data"): deletion takes effect immediately and covers your personal data and your audio files, as described in the privacy policy. The publisher may suspend an account in the event of a serious breach of these terms, after notice.

11. Changes to these terms

These terms may change. Any substantive change will be presented to you in the app and must be accepted again (full read, then acceptance) before you continue using the service. The current version and its date appear at the top of the document.

12. Governing law

These terms are governed by French law. In the event of a dispute, an amicable solution will be sought first; you may use a consumer mediator free of charge [MEDIATOR TO BE APPOINTED]. Failing that, the French courts have jurisdiction.

13. Language of the contract

These Terms of Use are a courtesy translation provided for your convenience. The contract is concluded in French: in the event of any discrepancy or dispute over interpretation, the French version of the terms (available at hypn.app/legal/conditions) prevails.
